These Terms and Conditions ("Terms") govern your use of the EFCTap services ("Services"), an electronic fare collection platform provided by EFCTap ("we," "us," or "our") for municipalities offering public transportation. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By registering for, accessing, or using the EFCTap Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users, including riders, municipalities, and third-party partners.

2. Description of Services

EFCTap provides an electronic fare collection platform that allows riders to pay for public transportation services offered by municipalities. This includes, but is not limited to, contactless payments, mobile app payments, and fare management for buses, trains, and other public transit systems. We act as a facilitator between riders and municipalities, ensuring secure and efficient payment processing.

3. User Eligibility

To use the Services, you must be at least 13 years of age. If you are under 18, you must have the consent of a parent or legal guardian to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

4. User Accounts and Responsibilities

To access certain features of the Services, you may need to create an account. You are responsible for:

  • Providing accurate and complete information during registration.
  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.

You agree not to share your account credentials with others or allow unauthorized access to your account. EFCTap reserves the right to suspend or terminate your account if we suspect fraudulent or unauthorized activity.

5. Payment Terms

Riders using the Services to pay for public transportation fares agree to:

  • Provide valid payment information (e.g., credit/debit card, mobile wallet).
  • Authorize EFCTap to charge the applicable fare to your payment method.
  • Pay any additional fees, such as transaction fees, as specified by the municipality or EFCTap.

All fares are determined by the municipality providing the public transportation service. EFCTap is not responsible for fare pricing, changes, or disputes. Refunds, if applicable, will be processed in accordance with the municipality’s refund policy.

6. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Attempt to hack, disrupt, or interfere with the Services, including the payment processing system.
  • Use the Services to engage in fraudulent transactions or activities.
  • Violate any applicable laws, regulations, or municipal policies while using the Services.

7. Intellectual Property

All content, trademarks, and intellectual property associated with the EFCTap Services, including the platform, mobile app, and website, are the property of EFCTap or its licensors. You may not copy, modify, distribute, or create derivative works of any part of the Services without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, EFCTap shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. This includes, but is not limited to, damages for loss of data, loss of profits, or service interruptions.

EFCTap is not responsible for the availability, reliability, or safety of public transportation services provided by municipalities. Any disputes related to transportation services, including delays, cancellations, or safety concerns, should be directed to the respective municipality.

9. Indemnification

You agree to indemnify and hold EFCTap, its affiliates, and its partners harmless from any claims, losses, damages, or expenses (including legal fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

EFCTap reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your account and right to use the Services will cease immediately.

11. Changes to the Terms

We may update these Terms from time to time to reflect changes in our Services or legal requirements. The updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state or province in which the municipality providing the public transportation service is located, without regard to its conflict of law principles.
